General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the website www.pensees-profondes.fr.

These Terms of Sale apply exclusively to individual consumers, within the meaning of the French Consumer Code.
Orders placed for professional, commercial, industrial, craft, or liberal activities are excluded from the contractual scope and do not constitute a business-to-business relationship.

2. Products

Pensées Profondes sells print-on-demand books.

Each book is manufactured after the order has been confirmed, which implies a production period before shipping.

Photographs, descriptions, and visuals presented on the website are provided for informational purposes only and are not contractually binding.

3. Orders

Any order placed on the website constitutes full acceptance of these Terms and Conditions of Sale.

An order is considered final once payment has been successfully validated.

Pensées Profondes reserves the right to refuse or cancel an order in the event of a dispute with the customer or suspicion of fraud.

4. Prices and VAT

Prices displayed on the website are indicated in euros (€).

For orders shipped within the European Union, VAT may be collected at checkout when required by applicable regulations (notably under the IOSS scheme for eligible shipments).

For orders whose total goods value exceeds €150, import duties, taxes, or customs fees may be charged by the authorities of the destination country.

Such fees remain the responsibility of the customer.

5. Payment

Payment is due immediately upon placing the order.

Payments are secured and processed through Shopify Payments or its payment partners.

Pensées Profondes does not have access to the customer's banking information.

6. Delivery

Books are printed and shipped from our production partners.

Delivery times indicated on the website are estimates only.

Pensées Profondes cannot be held responsible for delays caused by:

  • the carrier

  • customs procedures

  • circumstances beyond its control.

The risk of loss or damage is transferred to the customer once the parcel has been handed over to the carrier.

7. Right of Withdrawal and Returns

Customers benefit from a 14-day right of withdrawal starting from the date they receive the product for orders shipped within the European Union, in accordance with applicable regulations.

Return conditions, procedures, and applicable fees are detailed in our Return and Refund Policy.

8. Liability

Pensées Profondes shall not be held liable for indirect damages, loss of profits, or loss of data resulting from the use of the website or its products.

In any event, the liability of Pensées Profondes shall be limited to the amount of the order concerned.

9. Force Majeure

Pensées Profondes shall not be held liable for failure to perform its contractual obligations in the event of force majeure, including but not limited to natural disasters, strikes, transport disruptions, or unforeseen circumstances beyond its control.

10. Consumer Dispute Mediation

In accordance with the provisions of the French Consumer Code, customers may use a consumer mediation service free of charge to resolve disputes amicably.

11. Governing Law

These Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the competent courts shall be those within the jurisdiction of Paris (France), without prejudice to consumer protection provisions.
